What is the Visitor Visa?

Exceptional cases, like parents of an Australian resident or citizen, may have five years' validity in extraordinary situations, but this is not a five-year consecutive stay.

The Australian Sponsor's requirements:

  • Must be an eligible relative (partner, parent, child, sibling, grandparent, grandchild, aunt, uncle, niece, nephew).

  • A security bond is often required. This bond may be forfeited if you don't comply with visa conditions, like leaving before expiry.

Sponsorship is only required for the Sponsored Family stream. Tourist or Business Visitor applicants generally don't need one.

Countries with RHCAS are Belgium, Finland, Italy, Malta, the Netherlands, New Zealand, Norway, the Republic of Ireland, Slovenia, Sweden, and the UK. Comprehensive travel insurance is highly recommended regardless of RHCA status.

Conditions:

  • Condition 8503 - 'No Further Stay': Often on the Sponsored Family stream. This means you cannot apply for most other visas while in Australia. To apply elsewhere, you usually must leave.
    • Waiver: Rare. Only for compelling/compasionate circumstances arising since the grant, beyond your control, causing a significant change. Examples: serious illness preventing travel, death/serious illness of close family in Australia requiring your presence, disaster/unrest at home making return impossible/unreasonable. Generally not considered: marriage to an Australian, pregnancy (unless travel is unsafe), elective surgery. Waiver request needs substantial evidence.
  • Condition 8531 - 'Must Not Become An Offshore Person': Requires you to leave Australia before expiry.
  • Condition 8201 - 'Limited Study': Study limited to a maximum of three months.
  • Conditions 8189/8190: Specific business activity limits.
